What is Negligent Driving?

Negligent driving is when an individual drives in a way that falls below the reasonable standard of anyone else on the road. This means that you’re driving without considering the safety of others, even if it’s not on purpose. For example, obeying speed signs or knowing not to tailgate. It could also be not driving too quickly when it’s raining or even something as simple as keeping an eye out on upcoming traffic. You might not notice there’s brake lights in front of you one hundred yards up and have to slam on your breaks. Things like that definitely fall into the category of negligent driving.

If you are convicted of negligent driving, you can get points added to your California license. This can range from one – three points. If, for example, you are driving a commercial vehicle, you are more likely to have three points added. At an administrative hearing, however, you can submit evidence to refute the accusation that you are facing.
